Welcome to Baboo! These Terms of Service ("Terms") govern your access to and use of the Baboo mobile application ("App") and website (www.baboo.today), operated by Baboo ("we," "our," or "us").

By downloading, installing, accessing, or using Baboo, you agree to be bound by these Terms. If you do not agree to these Terms, please do not access or use the App.

1. Acceptance and Eligibility

• Age Requirement: You must be at least 13 years old (or 16 years old in certain jurisdictions) to use Baboo. By creating an account or using the App, you represent and warrant that you meet this age requirement.

• Account Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized access or security breach.

2. Description of Service

Baboo is a community platform designed for eye makeup enthusiasts to discover inspiring looks, explore eyeshadow color combinations, save looks to a personal Vault, create collections, and share creative eye makeup creations with other users.

3. User-Generated Content (UGC) Policy

Baboo allows users to post photos, videos, comments, color palettes, and other materials ("User-Generated Content" or "UGC"). To maintain a safe and inspiring community, you must adhere to our content rules.

Prohibited Content and Conduct

There is zero tolerance for objectionable, offensive, or abusive content on Baboo. You agree not to upload, post, or transmit any content that:

• Is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or hateful.

• Promotes discrimination, racism, hatred, violence, or harm against any individual or group.

• Contains sexually explicit, pornographic, or nude imagery.

• Infringes upon any third party’s intellectual property, trademark, privacy, or publicity rights.

• Contains unauthorized commercial communications, spam, phishing schemes, or malicious code.

• Depicts self-harm, dangerous behavior, or illegal activities.

4. Content Moderation, Reporting, and User Blocking

In compliance with App Store safety guidelines, Baboo enforces robust moderation systems to safeguard our community:

• Content Filtering: We utilize automated and manual screening mechanisms to detect and prevent objectionable content before or after publication.

• In-App Reporting: Users can easily report any post, comment, or profile that violates these Terms using the in-app "Report" button located on posts and profiles.

• User Blocking: Users can block any other user at any time using the in-app "Block" feature to immediately prevent them from interacting with or viewing your content.

• Enforcement Actions: We review reported content promptly. We reserve the right, at our sole discretion, to remove objectionable content, issue warnings, suspend accounts, or permanently ban users who violate these Terms without prior notice.

5. Intellectual Property Rights

• Your Ownership: You retain full ownership of the original eye makeup photos, videos, and media you submit or post on Baboo.

• License to Baboo: By submitting content to Baboo, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute your content solely for the purpose of operating, promoting, and improving the App.

• Baboo Intellectual Property: All branding, logos, graphics, designs, app interface elements, and software related to Baboo are the exclusive property of Baboo and protected by copyright and trademark laws.

6. Privacy

Your privacy is paramount to us. Our collection and use of personal data in connection with your access to and use of the App are described in detail in our Privacy Policy available at https://www.baboo.today. By using Baboo, you consent to our data practices as set forth in the Privacy Policy.

7. Account Termination and Deletion

• Termination by You: You can terminate your account and discontinue use of the App at any time via the in-app account deletion setting or by contacting us at service@baboo.today.

• Termination by Us: We reserve the right to suspend or terminate your access to Baboo immediately, without prior notice or liability, if you violate any provision of these Terms or engage in conduct detrimental to the community.

8. Disclaimers and Limitation of Liability

• "As-Is" Service: Baboo is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including performance, fitness for a particular purpose, or non-infringement.

• Limitation of Liability: To the maximum extent permitted by applicable law, Baboo and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your access to, use of, or inability to use the App, or any user-generated content posted by third parties.

9. Indemnification

You agree to indemnify, defend, and hold harmless Baboo and its team from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms or your user-generated content.

10. Governing Law, Updates, and Contact Information

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

Changes to These Terms

We reserve the right to modify these Terms at any time. Any changes will be published with an updated "Last Updated" date. Continued use of Baboo after any changes constitutes your acceptance of the new Terms.
